AIFMD: AIMA Publishes Guiding Principles for National Transposition of AIFMD & Level 2 Measures

On 26 March 2024, a Directive amending AIFMD and the UCITS Directive was published in the Official Journal of the EU. The Directive entered into force on 15 April 2024. Member States now have until 16 April 2026 to transpose the Directive into national law.

In order to encourage a faithful implementation of the Directive in national legislation, AIMA has published this Position Paper which provides guiding principles on some of the key elements of the new rules introduced under the AIFMD/UCITS review, in particular the cross-border lending passport. In addition, the Paper looks ahead to some of the upcoming Level 2 technical standards which are due to be adopted by the European Commission, following advice by ESMA. Here we provide guiding principles for the appropriate design of some of these standards, such as liquidity management tools.
